The owner of the online store shop.justadd.eu (hereinafter referred to as the Online Store) is Sushi Ekspert OÜ (registration code 12464992), located at Peterburi tee 2, Lasnamäe district, 11415 Tallinn, Harju county

Validity of the sales contract, product and price information

The terms of sale apply to purchases of goods from the Online Store. The prices of products sold in the Online Store are indicated next to the products.
A fee for delivery of the goods is added to the price. The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer when placing an order. Information about the goods is provided in the Online Store directly next to the goods.

Order processing

To order goods, you must add the desired products to the shopping cart. To place an order, you must fill in the required data fields and select the appropriate delivery method for the products. The amount of the fee will then be displayed on the screen, which can be paid via a bank link or other payment solution. The contract will enter into force upon receipt of the amount due to the Online Store’s current account.

If the ordered goods cannot be delivered due to the goods being out of stock or for another reason, the buyer will be notified as soon as possible and the money paid (including the costs of delivery of the goods) will generally be returned within 1-2 business days. Depending on the payment method, the receipt may take up to 7 business days.

Delivery

The buyer bears the shipping costs and the corresponding price information is displayed next to the shipping method.
Shipments within Estonia generally arrive at the destination specified by the buyer within 3-7 working days from the entry into force of the sales contract.
Outside Estonia, delivery generally takes place within 7-14 working days from the entry into force of the sales contract.

In exceptional cases, the Online Store has the right to deliver the goods within up to 30 calendar days. If the Online Store has informed the buyer on the website or in the order confirmation about delivery problems and a deadline exceeding 30 calendar days, the deadline published by the Online Store applies.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days. The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of return, the ordered goods may not be used in any way other than necessary to verify the nature, properties and functioning of the goods in the manner permitted for testing the goods in a physical store. If the goods have been used for a purpose other than necessary to verify the nature, properties and functioning of the goods or if they show signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.

To return the goods, a withdrawal form must be submitted, the form of which can be found here:
withdrawal form and sent to the email address no later than 14 days from receipt of the goods.
The costs of returning the goods are borne by the buyer, unless the reason for the return is that the item to be returned does not correspond to the order (e.g. a wrong or defective item).

The buyer must return the goods within 14 days of submitting the application or provide proof that he has handed over the goods to the carrier within the aforementioned period. Upon receipt of the returned goods, the online store will refund to the buyer immediately, but no later than 14 days after receipt of the withdrawal application, all fees received from the buyer under the contract.

The online store may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided evidence that he has returned the item, depending on which occurs first. If the buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the online store, the online store is not required to refund the consumer the cost that exceeds the cost of the standard delivery method.

The online store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store is significantly lower than the market price of the goods due to a mistake.

Right to file a claim

The Online Store is liable for any non-conformity or defect of the goods sold to the Buyer with the terms of the contract, which already existed at the time of delivery of the goods and which becomes apparent within two years from the delivery of the goods to the Buyer. During the first year from the delivery of the goods to the Buyer, it is assumed that the defect already existed at the time of delivery of the goods.

It is the responsibility of the Online Store to rebut this presumption. The Buyer has the right to contact the Online Store within two months of the occurrence of a defect by sending an e-mail to info@justadd.eu or by calling: (+372) 555 071 02. The Online Store is not liable for defects that have arisen after the delivery of the goods due to the consumer’s actions or inaction (incorrect use, accident, etc.) or if the goods are due to normal wear and tear due to normal use.

If the goods purchased from the Online Store have defects for which the Online Store is liable, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees incurred under the sales contract to the buyer. The Online Store will respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.

What personal data is processed?

  • name, telephone number and email address;
  • delivery address of the goods;
  • bank account number;
  • cost of goods and services and payment-related data (purchase history);
  • customer support data;
  • IP address

For what purpose is personal data processed?

Personal data is used to manage customer orders and deliver goods. Purchase history data (date of purchase, goods, quantity, customer details) is used to compile an overview of purchased goods and services, analyze customer preferences and, among other things, resolve consumer disputes.
The bank account number is used to return payments to the customer.

Personal data such as e-mail, telephone number, customer name are processed to resolve issues related to the provision of goods and services (customer support). E-mail is also used to send invoices and the telephone number is used to notify the parcel terminal that the goods have arrived. The IP address or other network identifiers of the online store user are processed to provide the online store as an information society service and to compile web usage statistics.

Legal basis

The processing of personal data is carried out for the purpose of fulfilling the contract concluded with the customer (management of customer orders, delivery, return of goods and payments).
The processing of personal data is carried out to fulfill a legal obligation (e.g. accounting).
The processing of personal data is necessary due to the legitimate interest of the controller, which consists in collecting purchase history data for the purpose of resolving possible consumer disputes.

Recipients to whom personal data is transferred

The name, telephone number and e-mail address are forwarded to the transport service provider chosen by the customer.
If the goods are delivered by courier, the customer’s address is also forwarded in addition to the contact details.
If the online store’s accounting is carried out by a service provider, personal data is forwarded to the service provider for accounting operations.
Personal data may be forwarded to information technology service providers if this is necessary to ensure the functionality or data hosting of the online store.

Security and data access

Personal data is stored on Zone Media OÜ servers located in a Member State of the European Union or a country that is a party to the European Economic Area. Data may be transferred to countries whose level of data protection has been assessed by the European Commission as adequate or to a company in a third country to which the protection measure referred to in Article 46 or 47 or 49(1) of the General Data Protection Regulation has been applied.

Access to personal data is available to online store employees, who can view personal data in order to resolve technical issues related to the use of the online store and provide customer support services.

The online store implements appropriate physical, organizational and information technology security measures to protect personal data from accidental or unlawful destruction, loss, alteration or unauthorized access and disclosure, including:

  • Data exchange with the e-shop takes place via an encrypted connection (TSL),
  • Customer passwords are stored encrypted (hashes),
  • Standard encryption is used when sending e-mails,
  • A firewall and appropriate antivirus have been implemented to protect the e-shop servers,
  • Regular backups are created and stored separately from the e-store server

The transfer of personal data to recipients who are authorized processors of the online store (e.g. transport service providers and data hosting) takes place on the basis of contracts concluded between the online store and the authorized processors. The authorized processors are obliged to ensure appropriate safeguards when processing personal data in accordance with Article 28 of the General Data Protection Regulation.

Access and correction of personal data

Personal data can be viewed and corrected in the online store user profile or through customer support. If the purchase was made without a user account, personal data can be viewed through customer support. If the request for access to personal data is submitted electronically, the information will also be provided via generally available electronic means.

Withdrawal of consent

If the processing of personal data is based on the client’s consent, the client has the right to withdraw the consent under the client account settings or by notifying customer support by email.

Storage

When closing an online store customer account, personal data will be deleted, except for personal data (purchase history data) that is required for accounting purposes or to resolve consumer disputes. In the case of disputes related to payments and consumer disputes, personal data will be stored until the claim is fulfilled or the statute of limitations expires. Personal data contained in the original accounting documents will be stored for seven years.

Restriction

The customer has the right to request restriction of the processing of their personal data if the data is incorrect or incomplete or if their personal data is processed unlawfully.

Objections

The customer has the right to object to the processing of his/her personal data if he/she has reason to believe that there is no legal basis for the processing of his/her personal data.

Deletion

To delete personal data, you must contact customer support by e-mail. The deletion request will be responded to no later than within a month and the period for which the data will be deleted will be specified. The response to the request will also indicate which personal data will not be deleted and on what legal basis and reason.

Transfer

A request for the transfer of personal data submitted by e-mail will be responded to within one month at the latest. Customer support will verify your identity and inform you of the personal data that is subject to transfer.

Direct marketing communications

The email address and phone number will be used to send direct marketing messages if the customer has given their consent. If the customer does not wish to receive direct marketing messages, they must select the appropriate link in the footer of the email or contact customer support. If personal data is processed for direct marketing purposes (profiling), the customer has the right to object at any time to the initial and further processing of their personal data, including profiling related to direct marketing, by informing customer support by email (the relevant information must be provided clearly and separately from any other information).

Dispute resolution

Disputes related to the processing of personal data are resolved through customer support (info@justadd.eu). The supervisory authority is the Estonian Data Protection Inspectorate (info@aki.ee)

Dispute resolution

If the buyer has any complaints regarding the Online Store, they should be sent by e-mail to info@justadd.eu or by phone: (+372) 555 071 02. If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer may turn to the Consumer Disputes Commission. The procedural conditions can be viewed and an application submitted here. The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the Commission is free of charge. The buyer may turn to the European Union’s consumer dispute resolution platform.
